The agreement and who we are
These terms of use apply to the use of Kulturjakten, meaning the app and related services. Link Utvikling AS is the provider of the service. By creating an account or using the service, you accept the terms.
About the service
The service lets you explore cultural monuments, cultural treasures and culture walks, collect points and take part in rankings and challenges. The service is normally free to use unless otherwise stated.
Who can use the service
The service is intended for users aged 14 and over. If you are under 18, you confirm that you have consent from a guardian where this is required.
Account and responsibility
To use key features you must create an account. You are responsible for the information you provide being correct and up to date, for keeping your login details secure, and for all activity from your account. As a rule you may only have one account for your own use, and you may not use someone else's account.
Points, rankings and fair play
Points, badges and rankings have no monetary value. They may be changed, reset or removed through updates, bug fixes, security measures or if the service is discontinued. They may also be revoked in case of cheating, exploiting bugs, GPS or location manipulation, automated use or other dishonest behaviour. We may take measures to detect and prevent abuse.
User-generated content
If you share text, images or other content, for example through Share your story, you keep your rights. At the same time you grant us a non-exclusive, royalty-free licence to store, process, moderate, publish and display the content in connection with operating, marketing and developing the service. You guarantee that you have the necessary rights to what you share, and that it does not infringe the rights of others. We may remove, hide or edit content that violates the terms, the law or our guidelines.
Permitted and prohibited use
You must use the service in a lawful and considerate manner. Among other things, it is not permitted to harass others, attempt to bypass technical restrictions or security, exploit vulnerabilities, manipulate the points system, falsify location, or copy and distribute the service without written permission.
Intellectual property
The service, including code, design, text, graphics, trademarks and functionality, is owned by us or our licensors and is protected by copyright and other legislation. You receive a limited, personal and non-transferable right to use the service in accordance with the terms.
Changes and discontinuation of the service
The service is provided in its current form and may change over time. We may update, change or remove features, close temporarily for maintenance or security, and discontinue the service with reasonable notice, normally 30 days. We may also restrict, suspend or terminate your access in case of breach of the terms or the law. You can stop using the service at any time and request deletion of your account.
Limitation of liability and safe use
The service is provided as is, and we do not guarantee that it is always error-free or uninterrupted. Using the service may involve moving around outdoors. You are responsible for acting with care, following traffic rules, access rules and signs, and respecting private property and nature. Use is at your own risk, and we accept no liability for damage or loss arising from use in traffic or terrain, unless otherwise required by mandatory law.
Governing law and disputes
The terms are governed by Norwegian law. Disputes shall first be sought resolved amicably. Failing that, the case may be brought before the ordinary courts with Bergen District Court as the venue, unless mandatory consumer rules give you the right to sue in your own venue.
